THE RIGHT TO DIGNITY OF PRISONERS OF WAR: PROBLEMS OF IMPLEMENTATION IN THE CONDITIONS OF MODERN WAR

Abstract

The article is devoted to the analysis of ensuring the right to dignity of prisoners of war in the conditions of the Russian-Ukrainian war. It was established that the chaotic nature of the war, the disregard of international norms by some parties and the evolution of the nature of armed conflicts create difficulties in ensuring the consistent observance of the declared rights of prisoners of war. The position of prisoners of war in the praxeological and normative aspect has an absolute dissonance, which demonstrates the fact that it is the field of legal protection of prisoners of war that represents the apogee of the problem in the field of international humanitarian law. It is indicated that the right to dignity is determined by the doctrine of constitutionalism and the rule of law as the primary essential determinant. The right to personal dignity is an integral part of humanity and a fundamental principle in modern society, which recognizes the need to respect human dignity and ensure conditions conducive to personal development and self-determination. The conclusion noted that the violation of the right to dignity of prisoners of war in the context of Russia's war against Ukraine is a serious and outrageous problem that causes general concern in the international arena. The main aspects of this violation are determined within the framework of this scientific study. First, there is a proliferation of situations of illegal detention, violating the right to freedom and security of prisoners of war. Secondly, there are indecent detention conditions that violate the standards of humane treatment and the right to dignity. Third, physical and mental abuse becomes an integral part of war, including beatings, torture, and inadequate medical care. This threatens not only dignity, but also the right to life. Fourth, failure to provide basic needs such as food and medical care violates the rights to dignity and human dignity. Fifth, the limitation of contact with the family and the uncertainty of the condition of prisoners of war worsen their mental stability and aggravate the humanitarian situation. These issues require immediate attention and action to protect the rights and dignity of those affected by this conflict.
