AGGRESSIVE BEHAVIOR IN MODERN TRANSITIVE SOCIETY: PHILOSOPHICAL-LEGAL AND THEORETICAL-LEGAL ASPECTS

Abstract

The author of the article analyzed the philosophical-legal and theoretical-legal aspects of the aggressive behavior of legal subjects in the transitive society of the modern legal reality. In general, the research proves that threats of a globalization, pandemic, transformational and transitive nature cause new additional means for subjects with aggressive behavior to implement illegal behavior. Postmodern society and informational factors are also additional factors for the transformation of the philosophical and legal understanding of the nature of aggressive behavior. It is indicated that the formation of the nature of aggression in an individual manifestation is reduced to the sphere of childhood. Behavioral and emotional problems are common in childhood, tend to be stable, and are associated with a wide range of negative outcomes over the life course, including criminal behavior. Two factors of the impact of modern social relations on aggressive behavior are singled out: the influence of the mass media and social networks (in times of uncertainty and unknown, they bear a significant responsibility for public mood, since these institutions are endowed with the potential to increase stress, but also to a certain level of confusion due to the ambiguity of information regarding risk assessment and precautionary measures); the legal policy to control the spread of the pandemic was accompanied by the restriction of human rights and freedoms, their legitimate interests, especially of an isolating nature, which led to the spread of manifestations of aggression against relatives and loved ones, and provoked a sharp increase in domestic violence. It is emphasized that the legal status of social networks in the era of information and communication transformations and updated social reality is beyond the boundaries of clear legal influence and regulation, so the information received through these channels may contain significant aggressive manifestations, manifestations of intolerance and forms an intolerant society in general.
