THE COMPLEXITY OF JUDICIAL INTEGRITY IN THE CONTEXT OF THE LATEST TRENDS IN LEGAL REALITY

Abstract

The article is devoted to the analysis of the main elements of a judge's integrity in modern conditions of the transformation of legal reality. It has been proven that the transformation of social relations through the increased use of means of information and technological progress, globalization and pandemic threats have caused a change in value and outlook, which is the basis of legal regulation and directly affects the change in the sphere of justice. Global transformational phenomena are changing the legal reality, including providing a new pragmatic and methodological approach to the judicial branch of power. It is indicated that distance justice requires additional updated rules regarding the participants in the judicial process, the role and behavior of the judge. With the growing importance of information technologies, the normalization of the specified issue will continue to be important. Emphasis is placed on trends in the use of artificial intelligence in the administration of justice in typical cases. This is inconsistent with the concept of fair justice, which seeks to apply consistent principles and is ready to reject general models in favor of unique circumstances. The peculiarity in the context of the transformation of the integrity of the judicial system is that the latest technologies will not only change the mechanisms of judicial proceedings, but they will also affect the judicial values possessed by the empowered subjects of the administration of justice, as well as transform the approach to justice in general. The following elements of the integrity of judges in the modern society of the transitional model are singled out: justice of court decisions; avoiding discrimination, intolerance or inequality in the administration of justice; tolerance of communication in judicial and extrajudicial proceedings; reasonable use of powers in the area of judicial decision discretion; compliance of the judge's behavior with the general moral and ethical value determinants prevailing in social reality.
