PROTECTION OF HUMAN AND CITIZEN RIGHTS AND FREEDOMS IN THE ADMINISTRATIVE JUDICIARY IN THE CONDITIONS OF INFORMATIZATION OF SOCIAL REALITY
Abstract
The article researches the guarantees of protection of human and citizen rights and freedoms in administrative proceedings under the conditions of informatization of social reality. It is indicated that administrative justice plays an important role in the legal system, ensuring the protection of the rights and interests of citizens and guaranteeing the legal responsibility of public bodies. The role and significance of administrative proceedings is to ensure legal protection of citizens and legal entities in relations with state bodies. The author positions electronic justice as the use of modern information and communication technologies in the legal system with the aim of improving access to justice, automating court procedures and increasing the efficiency of judicial proceedings Electronic justice works in accordance with established norms and standards, ensuring fairness, transparency and accessibility for all participants in the legal process. At the same time, the e-justice system must support basic principles such as the presumption of innocence, the right to a fair trial, equality before the law, and others that ensure the observance of rights and citizens in the virtual court environment. Therefore, the electronic justice system, while bringing a number of significant advantages, in particular, the simplification of document flow and the possibility of remote access by participants in the court process, nevertheless presents additional challenges for rulemakers and law enforcers. The main problems that the modern system of administrative justice may face in the context of the introduction of the latest information technologies are grouped: technical problems and shortcomings, which may include insufficient reliability of information systems, the possibility of technical failures and communication problems; the issue of accessibility can also become an obstacle, since not all citizens can have easy access to electronic systems, this is especially important for those who do not have access to IT devices or the Internet; issues of protection of personal data and confidential information and improvement of cyber security measures.
