STRENGTHENING THE PROTECTION OF PERSONAL DATA IN UKRAINE IN THE CONTEXT OF FOREIGN ECONOMIC ACTIVITY
Abstract
This paper examines various aspects of strengthening the protection of personal data in Ukraine in the context of foreign economic activity. The aim of the paper is to analyze the problems of legal framework for personal data protection in Ukraine in the context of foreign economic activity and specify possible ways to eliminate them. Provisions of the draft law No. 8153 «On Personal Data Protection» are analyzed for their compliance with the approaches of the General Data Protection Regulation of the European Union. The paper argues that states and international organizations are classified as those that provide an adequate level of protection of personal data, if they are covered by the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data, as amended by CETS Protocol No. 223. It is proposed to give the supervisory authority the right to recognize not only states, but also territories and specified sectors within that states as ensuring adequate protection of personal data. As the study shows, the criteria used to make a decision on an adequate level of personal data protection in a foreign state or international organization should be supplemented with a requirement for an independent supervisory authority. In addition, it is advisable to enshrine the definition of binding corporate rules in the draft law «On Personal Data Protection». In European Union law, these rules mean personal data protection policies which are adhered to by a controller or processor established on the territory of a Member State for transfers or a set of transfers of personal data to a controller or processor in one or more third countries within a group of undertakings, or group of enterprises engaged in a joint economic activity. The development and approval of the procedure for the exchange of information on binding corporate rules between controllers, operators and the supervisory authority after the adoption of the new Law of Ukraine «On Personal Data Protection» are substantiated.
