HUMAN RIGHTS AND POSITION OF CIVIL SOCIETY: DYSONANCE PROBLEMS

Abstract

The article analyzes the possibilities of legitimate restriction of rights through the opposition of society on the basis of violation of the principles of morality and traditional way of cohabitation. In particular, the counteraction to the specified positions is actualized in light of the latest trends in the ideology of non-discrimination, in particular on the criterion of gender identity and sexual orientation. It is determined that there is a dissonance between the right of a person with non-traditional identity and the position of civil society. It is indicated that the limits of the rights of persons with non-traditional orientation are on the junction of ensuring the best interests of the child, cultural, mental and moral values that dominate in society. The position on the prematurity of legalization of a single-gendered partnership in Ukraine is defended and we indicate the need for a referendum on the possibility of the same-gender unions and their adoption of children.
