THE RIGHT TO SECURITY SECONDARY LEGAL ASSISTANCE AS A WAY FOR ACCESSION OF JUSTICE IN UKRAINE
Abstract
The article provides a comparative description of the problems and prospects of the development of the right to free secondary legal aid as an important constitutional guarantee of the availability of justice in Ukraine. It is noted that providing effective legal aid is through the creation of interconnected system components — primary and secondary free legal aid; ensuring the proper level and optimal order of payment of legal aid at the expense of the state budget; establishing a clear circle of subjects of the right to free secondary legal aid as well as types of this assistance. It was established that the right to free secondary legal aid may be exercised by some subjects of this right only a limited number of times, namely no more than six times during the budget year and no more than six orders for the provision of secondary legal aid free of charge issued by the centers provision of free secondary legal aid at the same time. The argument about the expediency of introducing such restrictions for preventing the abuse of the right to free secondary legal aid in Ukraine is stated.
